Terms

The rules for the account and the backup.

Effective 21 October 2026. These terms cover the FotoSafe website at fotosafe.net and the FotoSafe Windows app. Creating an account, signing in, or backing up a photo means you agree to these terms and the Privacy Policy.

The service

FotoSafe keeps a backup of photos you choose to store, and it can hold blurry frames and spare shots of a burst until you decide. The checks for blur, shake, and faces run on your computer or in your browser. The backup is a copy kept for your account. It is not a promise that every file on a computer has been copied, and it is not a substitute for keeping your own copies.

Each account has the storage of its plan: 10 GB on Free, 500 GB on Personal, and 2 TB shared on Family. A photo that would pass that limit is not added.

Your account

You need an account to back photos up from the website. The email address is the account name. You can create it with a password of at least 10 characters, or with Google. A password account opens after you confirm the email. You are responsible for the email account and, if you use one, the password. Do not share the account.

The first time a Google account is used, FotoSafe creates the FotoSafe account. Later sign-ins with that same Google account open it. If that email already has a FotoSafe password, the password remains the way into that account.

Your photos

You keep ownership of the photos you back up. You confirm that you have the right to store them and to let FotoSafe keep a copy so the service can show them back to you. FotoSafe does not claim ownership of the pictures and does not license them to anyone else.

Do not upload a photo you are not allowed to store. Do not use FotoSafe to break the law, to attack the service, or to reach another person’s account or backup.

Sharing

You can share an album or a slideshow through a link. You choose who can open it, whether originals can be downloaded, and when it stops working, and you can stop sharing at any time. Share only photos you have the right to share. Anyone who can see a shared photo can save it, so a copy cannot be taken back once it has been seen. A photo someone adds to your shared album stays theirs and stays in their backup; if they delete it there, it leaves the album.

Family

The owner of a Family plan pays for it and can invite up to 5 people, remove them, or hand the plan to another member. Each member keeps ownership of their own photos. When someone leaves or the plan ends, their photos stay in their own backup under their own plan’s storage limit, as the Deletion section explains.

Legacy contact

Legacy is a one-time add-on. FotoSafe does not check why an account stopped being used; access opens only through the steps on the Legacy page: inactivity for the time you chose, a request from a contact you named, and 14 days in which you can cancel. Keep your contacts up to date. Photos a contact copies into their own backup become part of their account.

Deletion

You can delete the account while signed in. That removes the account and the photos in its backup. Removing a file on your computer does not remove it from the backup. FotoSafe may suspend an account that breaks these terms. FotoSafe does not delete photos from an account that is paid for. If an account is not on a paid plan and its backup is bigger than its plan allows, for example after a paid plan ends or after leaving a family, it has 90 days. We email you when that starts, 30 days before, 7 days before and the day before. After 90 days, FotoSafe deletes the most recently uploaded photos until the backup fits the plan; the oldest photos are kept. Choosing a plan, or getting the backup under the limit, stops this. Nothing is deleted while a legacy contact’s access is open.

The service can change

FotoSafe may change, pause, or stop parts of the website or the app. If these terms change, the new date will appear at the top of this page. Continuing to use the account after that date means you agree to the updated terms.

Responsibility

FotoSafe is provided as it is available. To the extent the law allows, FotoSafe is not liable for lost photos, lost profits, or indirect damages, and its liability for a claim about the service is limited to the amount you paid for FotoSafe in the three months before the claim. If you paid nothing, that limit is zero. Some places do not allow these limits, and in those places the limit is the smallest the law allows.

These terms are governed by the laws of the United States. Questions about them go to the operator of fotosafe.net.
